Since #2 is this:

 2) empirically detectable "miraculous appearing" design-directed action.

I would say that one doesn't have to expressly deny something to actually not be living it. Most adulterers don't deny that it is wrong, they just do it. (no one will like this statement but please have the sophistication to abstract the true meaning (which you say you can do in genesis) from the specifics).
