That depends, as we have seen in Kitzmiller for instance. Although the
defense claimed that ID was not religious, it was found that it lacked
a secular purpose (science) and combined with its religious
foundations and implications it failed to pass uster.

There is quite some good legal overview of this, although for instance
the Lemon test has been watered down recently.

If preferential treatment is given to an idea which has clear
religious implications (and the standard to determine this can include
legislative history, the history of the idea itself, as well as how
such ideas are viewed by third parties) and lacks a clear secular
purpose.
