There is an interesting article on ID and establishment clause law in the
current issue of the Harvard Journal of Law and Public Policy. Here is a

The article's focus is on the "objective observer" test, which inquires
about the government's motives in adopting a given policy. There article
provides a pretty good summary of the ID debate in general and places it
within the context of the "objective observer" jurisprudence. If nothing
else, you can see from this author's discussion what a tortured mess the
establishment clause jurisprudence has become.
